Privacy Policy

How Fendaro collects, uses, stores and protects your personal information, in line with the Protection of Personal Information Act, 2013 (POPIA).

1. Who we are

This policy is issued by FDN Capital Advisory (Pty) Ltd, trading as Fendaro ("we", "us", "our"), a company registered in South Africa. We are the responsible party for personal information processed through fendaro.pro and our advisory services, as contemplated in POPIA.

2. Information we collect

We collect personal information directly from you and, where relevant, in the course of delivering advisory, valuation, due diligence and tax structuring services. This may include:

  • Identifying details such as name, job title and company you represent.
  • Contact details such as e-mail address, phone number and postal address.
  • Information you submit through our contact form or newsletter sign-up.
  • Financial and business information you share with us for the purpose of an engagement (e.g. valuations, due diligence, tax matters).
  • Technical information collected via cookies, such as browser type, pages visited and time on site (see our Cookie Policy).

3. Why we process your information

We process personal information for the following lawful purposes:

  • To respond to enquiries submitted through our contact form and to provide requested information about our services.
  • To perform and administer advisory, valuation, due diligence and tax structuring engagements.
  • To send our monthly newsletter and other communications, where you have opted in.
  • To operate, secure and improve fendaro.pro, including through analytics cookies where consented to.
  • To comply with legal, regulatory, tax and accounting obligations applicable to us in South Africa.

4. Legal basis for processing

We rely on one or more of the following grounds recognised under POPIA: your consent; the necessity of processing to conclude or perform a contract with you; compliance with a legal obligation to which we are subject; and our legitimate interests in operating and marketing our advisory business, provided these do not override your rights.

5. Contact form and newsletter data

When you submit our contact form, we process the details you provide (name, e-mail, phone, message) solely to respond to your enquiry and, where applicable, to open a client engagement. When you subscribe to our newsletter, we process your e-mail address to send periodic insight communications; you may unsubscribe at any time using the link in every newsletter or by contacting us directly.

6. Cookies

Our website uses essential, analytics and marketing cookies, managed through an on-site consent tool. Essential cookies are always active; analytics and marketing cookies are only set with your consent. 7. Hosting and third parties

Our website and associated infrastructure are hosted with reputable service providers who process data on our behalf under appropriate confidentiality and security arrangements. We may also share personal information with professional advisors (e.g. auditors, legal counsel), regulatory bodies where legally required, and service providers supporting our newsletter, analytics and IT systems. We do not sell personal information to third parties.

Where any processing involves a transfer of personal information outside South Africa, we take reasonable steps to ensure the recipient is subject to a data protection standard that provides adequate protection, consistent with POPIA's cross-border transfer requirements.

8. Data retention

We retain personal information only for as long as necessary to fulfil the purposes described in this policy, including any legal, accounting or reporting requirements applicable to advisory and tax-related engagements in South Africa. Contact form and enquiry data not converted into a client relationship is retained for a limited period and then securely deleted or anonymised.

9. Security measures

We implement reasonable technical and organisational measures to protect personal information against loss, unauthorised access, alteration or disclosure, appropriate to the nature of the information we hold, including restricted access controls and secure hosting environments.

10. Your rights under POPIA

As a data subject, you have the right to:

  • Be notified that personal information about you is being collected.
  • Access the personal information we hold about you.
  • Request correction, updating or deletion of inaccurate, irrelevant, excessive or unlawfully obtained personal information.
  • Object to the processing of your personal information for direct marketing purposes at any time, free of charge.
  • Withdraw consent to processing where processing is based on consent, without affecting the lawfulness of processing carried out prior to withdrawal.
  • Submit a complaint to the Information Regulator of South Africa if you believe your rights under POPIA have been infringed.

We may update this policy from time to time to reflect changes in our practices or legal requirements. The current version will always be available at fendaro.pro/privacy.html, with the effective date noted below.
